What is it?

For the first time, the adoption and implementation of robust multi agency adult safeguarding arrangements is now a strict legal requirement for all General Practitioners; dentists; pharmacists; NHS hospitals; and housing, health and care providers.

There is now a broader definition to the new term “adult at risk” which refers to any person aged 18 years and over who:

  • has needs for care and support and;
  • is experiencing, or is at risk of, abuse and neglect and;
  • as a result of those care needs, is unable to protect themselves from either the risk of, or the experience of, abuse or neglect.

This could include any adult receiving any medical care or treatment, living in a residential setting, those with mental health issues, physical, sensory or learning disabilities, medical conditions, dementia, brain injury, those who are elderly and frail and also those who are family carers.

What do I need to do?


The law and guidance is clear that all those working with adults at risk, their families, parents and carers have clear legal responsibilities and should have the following in place:

  • Current and robust adult safeguarding policies and procedures for managing concerns, making referrals, workforce allegations, information sharing and “whistle blowing”
  • Safer recruitment practices and making referrals to the DBS and CQC
  • Comprehensive staff training at all levels compatible with both CQC and agency/sector standards.

All front line staff should be familiar with the recognition and prevention of FGM.
All front line staff need to be aware of the Prevent Duty under the Counter-Terrorism and Security Act 2015.

Care Homes Only

The new Criminal Justice and Courts Act 2015, defines a new offence of wilful neglect for care provider staff and this is extended beyond the workforce to directors and managers if there has been a gross breach of duty of care. The offence caries a five year jail sentence.

Health only

CQC Fundamental Standards 2014 for NHS trusts, Foundation Trusts and some special health authorities that provide care and treatment to people that are regulated by CQC :

  • Care and treatment must be appropriate and reflect service users' needs and preferences.
  • Service users must be treated with dignity and respect.
  • Care and treatment must only be provided with consent.
  • Care and treatment must be provided in a safe way.
  • Service users must be protected from abuse and improper treatment.
  • Service users' nutritional and hydration needs must be met.
  • All premises and equipment used must be clean, secure, suitable and used properly.
  • Complaints must be appropriately investigated and appropriate action taken in response.
  • Systems and processes must be established to ensure compliance with the fundamental standards.
  • Sufficient numbers of suitably qualified, competent, skilled and experienced staff must be deployed.
  • Persons employed must be of good character, have the necessary qualifications, skills and experience, and be able to perform the work for which they are employed (fit and proper persons requirement).
  • Registered persons must be open and transparent with service users about their care and treatment (the duty of candour).
