Changes to Keeping Children Safe in Education for publication September 2018
The guidance has been amended throughout to reflect that from April 1 2018 that the National College for Teaching and Leadership (NCTL) no longer exists and regulation of the teaching profession including misconduct hearings are dealt with by the Teaching Regulation Agency (TRA) which is an executive agency of the Department of Education (DfE). The DfE now handles all other functions once held by the NCTL
Throughout some passages have been updated in line with references and better ways of expression.
What is the status of the document?
• This document does not become current until 3rd September 2018 and should be read in conjunction with 2018 Working Together to Safeguard Children when it also has been published.

Who is this guidance for?
This section reflects the changes to who delivers education
This statutory guidance should be read and followed by:
• governing bodies of maintained schools (including maintained nursery schools) and colleges;
• proprietors of independent school or schools (including academies, free schools and alternative provision academies) and non-maintained special schools. In the case of academies, free schools and alternative provision academies, the proprietor will be the academy. trust; and · management committees of pupil referral units (PRUs).
The above persons should ensure that all staff in their school or college read at least Part one of this guidance.

Part one: The role of school and college staff
• What was paragraph 8 is now 10. “Every school and college should have a designated safeguarding lead (DSL) who will provide support to staff members to carry out their safeguarding duties and who will liaise closely with other services such as children’s social care.”
• New paragraph 8. “All staff should be prepared to identify children who may benefit from early help. “Early help means providing support as soon as a problem emerges at any point in a child’s life, from the foundation years through to the teenage years.”
• Original 9 replaced. “Any staff member who has a concern about a child’s welfare should follow the referral processes set out in paragraphs 23-34. Staff should expect to support social workers and other agencies following any referral.
• Paragraph 11 replaced as: The designated safeguarding lead (and any deputies) are most likely to have a complete safeguarding picture and be the most appropriate person to advise on the response to safeguarding concerns.”
• Original paragraph 10 deleted
Original paragraph 12 now 13 and has in addition to original list, of policies all staff must be made aware of which was:
Ø The child protection policy
Ø The staff behaviour policy (sometimes called a code of conduct)
Ø The role of the designated lead (has added to this) including the identity of the designated safeguarding lead and any deputies).
And now includes:
Ø The behaviour policy
Ø The response to children who go missing from education and
• Paragraph 18 provides additional information on early help
• Paragraph 23 updated to reflect concerns about a child’s welfare should be acted upon immediately.
• Paragraph 24 updated to reflect the importance of speaking with the DSL and following the local child protection policy.
• Paragraph 25 clarifies the options for action when staff, have concerns.
• Paragraph 27 explains the importance of information sharing.
• Paragraph 28 makes clear that generally the DSL takes the lead on early help cases.
• Paragraph 31 provides more information on what to expect from the local authority.
• Paragraph 35 was 27 and has been updated to reflect that all staff should raise any FGM related concerns with the DSL (or deputy) and then makes the link to the legal requirements on teachers.

Part two: The management of safeguarding
• Paragraph 55 now makes clear that Board level leadership lead should sit at governing body or proprietor level.
• Paragraph 57 now has child protection information in one place and makes clear that all schools and colleges should have their own individual child protection policy, which reflects local circumstances.
(this does not stop a proprietor of multiple schools having an overarching child protection policy but must be built on by individuals to reflect local policies and procedures)
This paragraph also includes, regarding children who go missing from education, the need, where possible to have more than on emergency contact number for all pupils/students.
• Paragraph 61 emphasises the importance of the appointment of the DSL and that the DSL is a member of the senior leadership team. (who appoints them is a matter for the governing body or proprietor)
• Paragraph 74 and 75 describes the importance of the DSL’s responsibilities in regard to child protection files and passing them on. Consideration should always be considered to information sharing in advance to a file being transferred.
• Paragraph 80 makes clear that safeguarding includes “online safety”
• Paragraph 85 now clarifies that at least one of the persons who conduct an interview has completed safer recruitment training.
• Paragraph 90 emphasises the importance of policies reflecting peer on peer abuse.
• Paragraph 95 has been added to take into account that previously looked after children remain vulnerable and the importance of agencies working together to continue to safeguard them.
• Paragraph 96 to 100 updated to reflect the Children and social Work Act 2017
• Paragraph 101 reflects care leavers
• Paragraph 103 to 105 covers the use of reasonable force.
Part three: Safer recruitment
This section has been amended and revised to clarify and reflect the current requirements on school and colleges. It explains the term supervision in the context of regulated activity and the position on personal care.
Many of the paragraph and footnotes have been revised and added to, so this section should be used and followed, in its entirety, each time recruitment is undertaken.
Part four: Allegations of abuse made against teachers and other staff
This section looks at duties as an employer of all staff including volunteers.
There are many revisions and updates to this section. As it will only be needed when allegations have been made against a member of staff, whether still in employment or of an historical nature then it is advisable to use the whole section each time to provide explicit guidance.
Part five: Child on child sexual violence and sexual harassment
This new section has been written to provide guidance for schools and colleges on how to respond to reports of child on child sexual violence and sexual harassment.
Annex A contains important additional information about specific forms of abuse and safeguarding issues. School and college leaders and those staff who work directly with children should read this annex.
Annex B: describes the role of the designated safeguarding lead and the deputy safeguarding lead. This has been updated.
Annex C updated to include more information and links to additional support
Annex D has added reference to Long-term Residential Care Regulations 2011 as it applies to schools and colleges
Annex E regarding host families, this has been revised to provide clarity on obtaining DBS checks for UK host families who provide homestay to pupils during exchange visits.
Annex G lists Disclosure and Barring Service checks.
